These Terms of Service (“Terms”) govern your use of the Especia mobile app, the Especia Pro mobile app, the Especia Pro web platform, and the especia.app websites, operated by Valentina Fernández Salmerón (“we”, “us”, or “our”). By creating an account or using our services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use Especia. By creating an account, you represent and warrant that you are 18 or older. Especia Pro is intended for modeling agencies and talent management professionals. By registering an agency account, you represent that you have the authority to act on behalf of the agency.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information during registration and keep it up to date. You may not impersonate another person, create multiple accounts, or transfer your account to another person.
You may delete your account at any time through the app's settings.
3. User Content
You retain ownership of all content you upload, including photos, videos, and text (“User Content”). By posting User Content, you grant Especia a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the platform.
You represent that you have all necessary rights to the content you post, including model releases and photographer permissions where applicable. You are responsible for ensuring your content does not infringe third-party rights.
4. Acceptable Use
You agree not to:
- Post content that is illegal, defamatory, harassing, threatening, or discriminatory
- Upload sexually explicit or exploitative content
- Use the platform for any fraudulent or deceptive purpose
- Attempt to gain unauthorized access to other accounts or systems
- Scrape, crawl, or automatically collect data from the platform
- Interfere with or disrupt the platform's operation
- Use the platform to spam or send unsolicited messages
- Post fake, misleading, or retaliatory reviews, or review a job you were not part of
- Create new accounts or content to get around a block, suspension, or moderation decision
5. Content Moderation & Safety
We screen uploaded content automatically and may also review it manually. We may hold, hide, or remove content, and restrict or suspend accounts, that break these Terms or put others at risk. We have zero tolerance for objectionable content and abusive users.
You can report content and users, and block other users, from within the apps. We review reports promptly and act on them.
If your content is held or removed, you can ask us to review the decision again by contacting us.
6. Communities & Reviews
You can create public or private communities. Community admins decide who may join a private community and are responsible for keeping it within these Terms. Anyone who has a private community's invite link can join it, so share it carefully; admins can reset the link at any time.
After a completed job, the people and organizations involved can review each other. Reviews must be honest and based on your own experience. You may post a review anonymously; we still know who wrote it, and we may remove reviews that break these Terms.
7. Agency Responsibilities
If you use Especia Pro, you additionally agree to:
- Maintain accurate information about your agency and roster models
- Obtain proper authorization before adding models to your roster
- Comply with all applicable employment, labor, and modeling industry laws
- Provide truthful job postings with accurate compensation and requirements
- Respond to model applications in a timely and professional manner
- Not use the platform for any illegal, fraudulent, or exploitative purpose
- Make sure the people you add to your organization follow these Terms; you are responsible for activity by your organization's members
8. Subscriptions & Payments
The Verified Model subscription includes identity verification at no separate charge, a blue badge, priority within otherwise relevant search results, and access to subscriber-only castings. These benefits activate only after Stripe verifies that the subscriber is 18 or older and that the same legal identity is not linked to another Especia account. They require both a valid identity result and an active Apple subscription. Search priority does not guarantee discovery, representation, or work. Especia Pro separately offers organization subscriptions, billed by Apple for App Store purchases or Stripe for web purchases.
Subscriptions renew automatically unless cancelled. Verified Model subscriptions are billed by Apple and can be cancelled in App Store subscription settings; Apple's terms govern payment, renewal, cancellation, and applicable refunds. Especia Pro purchases made through the App Store are billed by Apple and managed in App Store subscription settings; Apple reviews refund requests. Web purchases are billed by Stripe and managed in the billing dashboard. Cancellation stops future renewal and normally preserves access through the current paid period. Requesting a refund does not itself cancel renewal.
We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing period.
9. AI Features
The Especia Pro AI assistant uses AI to generate answers and suggestions, which can be inaccurate or incomplete. Check them before relying on them. You are responsible for any action you confirm.
10. Platform Interactions
Especia facilitates connections between models and agencies. We are not a party to any employment, representation, or booking agreements between users. We do not verify agency credentials, employment offers, or payment guarantees. Exercise your own judgement when interacting with other users and never share financial information through the platform's messaging system.
11. Intellectual Property
The Especia name, logo, and platform design are our intellectual property. Content you upload (photos, videos, agency logos, job descriptions) remains yours, but you grant us a license to display it on the platform as described in Section 3. You may not copy, modify, or distribute any part of our platform without written permission.
12. Disclaimers
Especia is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the platform will be uninterrupted, secure, or error-free. We are not responsible for the actions of other users.
13. Limitation of Liability
To the maximum extent permitted by law, Valentina Fernández Salmerón shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the platform, including but not limited to lost bookings, missed opportunities, or data loss. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we determine, in our sole discretion, that your use poses a risk to the platform or other users. Upon termination, your right to use the platform ceases immediately. You may appeal account actions by contacting us.
15. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated through the platform. Your continued use after changes take effect constitutes acceptance. If you disagree with updated Terms, you should stop using the platform and delete your account.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law provisions. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.
