These Terms of Service (“Terms”) govern your use of the Especia mobile application and the Especia for Agencies web platform, operated by Valentina Fernández Salmerón (“we”, “us”, or “our”). By creating an account or using our services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use Especia. By creating an account, you represent and warrant that you are 18 or older. The Especia for Agencies platform is intended for modeling agencies and talent management professionals. By registering an agency account, you represent that you have the authority to act on behalf of the agency.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information during registration and keep it up to date. You may not impersonate another person, create multiple accounts, or transfer your account to another person.
You may delete your account at any time through the app's settings.
3. User Content
You retain ownership of all content you upload, including photos, videos, and text (“User Content”). By posting User Content, you grant Especia a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the platform.
You represent that you have all necessary rights to the content you post, including model releases and photographer permissions where applicable. You are responsible for ensuring your content does not infringe third-party rights.
4. Acceptable Use
You agree not to:
- Post content that is illegal, defamatory, harassing, threatening, or discriminatory
- Upload sexually explicit or exploitative content
- Use the platform for any fraudulent or deceptive purpose
- Attempt to gain unauthorized access to other accounts or systems
- Scrape, crawl, or automatically collect data from the platform
- Interfere with or disrupt the platform's operation
- Use the platform to spam or send unsolicited messages
5. Agency Responsibilities
If you use Especia for Agencies, you additionally agree to:
- Maintain accurate information about your agency and roster models
- Obtain proper authorization before adding models to your roster
- Comply with all applicable employment, labor, and modeling industry laws
- Provide truthful job postings with accurate compensation and requirements
- Respond to model applications in a timely and professional manner
- Not use the platform for any illegal, fraudulent, or exploitative purpose
6. Subscriptions & Payments
Especia for Agencies offers tiered subscription plans based on roster size. Payment is processed securely by Stripe. By subscribing, you agree to Stripe's terms of service.
Subscriptions renew automatically. You can cancel at any time via your billing dashboard; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing period.
7. Platform Interactions
Especia facilitates connections between models and agencies. We are not a party to any employment, representation, or booking agreements between users. We do not verify agency credentials, employment offers, or payment guarantees. Exercise your own judgement when interacting with other users and never share financial information through the platform's messaging system.
8. Intellectual Property
The Especia name, logo, and platform design are our intellectual property. Content you upload (photos, videos, agency logos, job descriptions) remains yours, but you grant us a license to display it on the platform as described in Section 3. You may not copy, modify, or distribute any part of our platform without written permission.
9. Disclaimers
Especia is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the platform will be uninterrupted, secure, or error-free. We are not responsible for the actions of other users.
10. Limitation of Liability
To the maximum extent permitted by law, Valentina Fernández Salmerón shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the platform, including but not limited to lost bookings, missed opportunities, or data loss.
11. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we determine, in our sole discretion, that your use poses a risk to the platform or other users. Upon termination, your right to use the platform ceases immediately. You may appeal account actions by contacting us.
12. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated through the platform. Your continued use after changes take effect constitutes acceptance. If you disagree with updated Terms, you should stop using the platform and delete your account.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law provisions.
